Qualifications requirements; As per below Terms of Reference (ToRs)
- Terms of Reference (ToR)
Ngali Holdings Ltd (NH) is a private Limited company, whose main mission is investment. It has invested in various subsidiaries and affiliates. It has invested with foreign companies in Rwanda and is having some investment abroad. NH wishes to recruit the lawyer and or tax specialists responsible for drafting a transfer pricing policy. In doing so, shall do the following;
- Services
- Review Ngali Holdings Ltd (group) existing corporate structure in order to be able to draft relevant “Transfer pricing policy”
- Review Rwandan laws (related with the transfer pricing and taxation) and while drafting the Transfer pricing policy, be able to align and avoid contradictions;
- Review international treaties, Rwandan is having with the countries where our partners emanate and while drafting the transfer pricing policy, be able to align;
- Draft the transfer pricing policy and explain to NH management about the policy;
- Work on comments made by the NH management;
- The policy should be simple to comprehend, user friendly and capturing all elements of transfer pricing.
- Deliverable
The consultant shall be required to draft the transfer pricing for NH, share the it with the Client, hold meetings to explain the policy, incorporate comments by the Client and final product shall the policy approved by the board of directors.
- Requirements
- Demonstrate to have drafted or participated in transfer pricing policies
- Demonstrate having extensive knowledge of the in tax matters, particularly trans boarder taxation
- Having knowledge about complex company organization structure and inter relationships between parent company and its affiliates operating in various tax jurisdictions.
- Having legal and/or tax specialization
- The interested Party shall be preparing the bid with two sections (Technical and financial). The payment model shall be person-hour and is based on the take and pay principles.
