TERMS OF REFERENCE FOR ELABORATION OF CONTRACTORS OBLIGATIONS BOOKLET
1. BACKGROUND
The Rwanda Association of Building and Public Works Contractors; in French “Association des Entrepreneurs du Bâtiment et Travaux Publics” (AEBTP), established in November 1998, is regulated by law N° 51/2001 of 30/12/2001, its legal statutes have been published in the official gazette Year 44 n° 2 on 15th January 2005. It has been established in November 1998. It brings together all building and public works contractors in Rwanda with the aim of promoting their respective activities to substantially contribute to economic development of Rwanda. Since its creation, the association has advocated and promoted the interests of its members; improved conditions under which their profession is exercised; provided training and information; encouraged collaboration and partnerships as well as harmonizing professional relations for its members.
The Belgian Development Agency (Enabel) is supporting AEBTP to ensure an efficient facilitation of companies in order to successfully implement the WPL component of the urban development programme.
In line with Output 2: AEBTP's communication and outreach of its activities towards its members is strengthened, AEBTP wish to hire a consultant for elaborating a booklet that will gather all contractors obligations e.g. from company registration up to the conduct of daily business.
Despite many policies, laws and regulations that are in place to regulate the construction industry, they are very scattered and wide, we need to bind all contractors responsibilities and liabilities in a single booklet.
OBJECTIVE
The main objective of this assignment is to review all relevant existing documentation, and compile them into one booklet for allowing construction contractors to know and understand their responsibilities and liabilities
Specific objectives are:
Elucidate the nature of construction business in Rwanda.
Improve understanding responsibilities and liabilities of construction contractors.
Enhance professionalism of construction contractors and construction industry in general.
3. SCOPE OF WORK
The study will be conducted into different phases, with each phase being discussed with the consultant:
Gather and document all information related to the construction business, with more emphasis on construction contractor responsibilities and liabilities;
Produce the booklet consisting of responsibilities and liabilities of a contractor in construction in three languages (Kinyarwanda, English and French);
Printing sample 5 copies of the final booklet.
Throughout the assignment, the lead consultant is expected to attend relevant meetings with AEBTP and its partners to discuss the future programme.
4. DELIVERABLES
The consultant has to produce the following outputs:

1. Inception report including methodology and work plan 5 July 2021
2. First report including consulted documents and booklet design 15 July 2021
3. First draft booklet 26 July 2021
4. Final booklet 30 July 2021
Four presentations are foreseen to the quality review committee namely to
Validate the inception report,
Validate the First report including consulted documents and booklet design
Validate the first draft booklet.
Validate the final booklet.
After each presentation, the consultant will integrate comments and send a final version of each report. After submission of a report, the consultant can continue working on other reports while awaiting presentations. Payment will be made after validation of reports by the quality review committee.
5. CONSULTANCY MANAGEMENT, REPORTING ARRANGEMENTS, DURATION AND PAYMENTS
The contract manager from AEBTP for this consultancy the Executive Secretary of AEBTP. A quality control committee will be put in place at the beginning of the consultancy to approve inception report and other reports.

The consultancy assignment is expected to have an estimated duration of not more than 30 calendar days starting as soon as possible and to be completed mid July 2021.
The consultant will provide invoices after the validation of reports as mentioned above as per the fee agreed upon between AEBTP and the consultant.
6. CONSULTANT PROFILE
The consultant has to fulfil the requirements below:
Master’s degree in law;
At least 6 years’ practical experience in elaboration of construction laws in Rwanda, EAC, etc;
Experience in undertaking consultancy tasks of similar nature;
Proven experience with stakeholder consultations;
Excellent analytic skills;
Excellent writing skills in English.
Note that if a company applies, the company experience as such will not be considered but only these of the team members proposed.
7. EVALUATION CRITERIA
The following evaluation criteria and scoring will apply when evaluating consultants that submitted a bid for this consultancy.

8. BIDDING INSTRUCTIONS

Required information to submit are as follows:
Cover sheet indicating name of the consultant(s), contact details
Profile of the consultant including CV and showcasing how the consultant is corresponding the criteria mentioned under point 7 above (consultant profile)
Methodology, Work plan as per the above tasks and day allocation (point 3 above) with concrete timeline and deliverables. The work plan should indicate which consultant will be responsible for which task.
Financial proposal indicating a) the professional fee per day which should include all costs (e.g. communication, internet, printing).
