Context
This consulting mandate is part of the Compétences, Leadership, Éducation (Programme CLÉ) voluntary cooperation program implemented by a consortium composed of the Fondation Paul Gérin-Lajoie, Éducation internationale and the Fédération des cégeps and funded by Global Affairs Canada (GAC). The Programme CLÉ began in 2020 and will run until 2027 in 7 countries (Benin, Cameroon, Guinea, Rwanda, Senegal, Togo, Haiti). The program aims to increase the economic and social well-being of the most marginalized and vulnerable populations, particularly girls and women, by improving the quality of basic and secondary education and vocational and technical training (TVET). To do this, the Programme CLÉ intends to build the capacity of 47 partners to implement quality education initiatives and services that are more inclusive, innovative, environmentally sustainable, and advance gender equality.
In Rwanda, the Programme CLÉ is starting up and intends to recruit local staff. The consultant will therefore be responsible for ensuring that the process is carried out in compliance with labor laws.
2-Objective
The overall objective is to assist the CLÉ Country Office in its recruitment process and more specifically in the validation of the classification and salary scale of local positions, work contracts and the development of a pay slip template. Finally, the consultant will ensure the popularization of the rights and regulations of local workers in the Rwandan legislation through two advisory services sessions.
2-1 Validate the classification of local positions according to the collective agreement in force
On the basis of the recruitment TOR, the consultant specialized in labor law will validate the classification of the types of positions proposed by the program and the proposed salary scale.
2-2 Validate the compliance of the employment contracts with the regulations in force
Following the drafting of the contracts by the Programme CLÉ, the consultant will validate the conformity of the employment contracts and will propose adjustments if necessary.
2-3 Develop the pay slip template, ensuring that all employee contributions are at the current rates and that deductions are in accordance with regulations.
2-4 Inform the Programme CLÉ respondent of the employer's obligations and the various contributions.
Two counseling meetings will be organized to answer the questions of the Programme CLÉ respondent regarding the rights and obligations of the employer in the Rwandan context.
3- Expected results
The main expected results are:
● Job classifications and salary scales comply with current law
● Employment contracts comply with regulations
● A file for the preparation of pay slips is shared and takes into account the
compulsory contributions at current rates
● The rights and obligations of the employer are known by the Programme CLÉ respondent
4- Methodology
It is up to the consultant to propose its methodology that will allow the achievement of the objectives of this TOR.
5- Deliverables (in French or English)
● A job classification document respecting the legislation
● Employment contracts respecting the legislation
● A salary slip template where all mandatory contributions are present at the current rate
● A process report
6- Duration of the mission
The duration of the mission is at the discretion of the consultant but cannot exceed 3 working days for results 2.1 to 2.3.
The mission will take place between the end of February 2022 and the beginning of March 2022. Please, take note that these dates can vary depending on the recruitment process.
Consulting meetings may be scheduled in two stages, one in February and one in March.
7-Profile of the consultant
● The consultant may be an individual or a firm established in Rwanda ;
● Be a lawyer, labor inspector or HR specialist. Hold a higher education degree and have proven experience in the field.
● Have good listening and outreach skills.
8-Constitution of the file
The administrative file
Legalized copy of the CNI or legalized copy of any document justifying the legal existence (legal entity)
The technical file
The technical file must include a detailed CV, a note on the understanding of the present TOR, a description of the work methodology and references.
