The International Committee of the Red Cross (ICRC), an impartial, neutral and independent humanitarian organization has been permanently present in Rwanda since 1990. Having its headquarters in Geneva, Switzerland, the ICRC is given its mandate by the Geneva Conventions to protect victims of international and internal armed conflicts. Position: Legal Advisor

Reports to: Deputy Head of Delegation
Job Summary
The Legal Adviser advises the Delegation on International Humanitarian Law (IHL) and national and/or international legal matters and conducts related legal work. The Legal Advisor performs research, provides analysis and writes reports on relevant legal developments in Rwanda as required. S/he develops and maintains a network of contacts with key stakeholders in broader sectors of the national legal system and supports the Delegation efforts to influence on priority humanitarian concerns including through the Humanitarian events.
Accountabilities and Responsibilities:
National Implementation of IHL
• Reporting to the DHoD as direct line manager with the support of Regional Legal Advisor in Nairobi as a technical advisor, the Legal Advisor:
• Contributes to the formulation of the Delegation’s strategies, identifies and defines objectives and develops activities, particularly insofar as they relate to international and domestic laws.
• Analyses the situation, advises and provides guidance on the applicable national and international legal frameworks and norms in relation to the Delegation activities, objectives, strategies and plans of action to address identified legal and other related issues;
• Analyses government policy positions, legislation and jurisprudence that may have repercussions on ICRC activities in the country of assignment;
• Promotes the ratification of, or accession to, priority IHL treaties in Rwanda as defined by the Delegation in line with the Institutional priorities;
• Supports IHL dissemination activities directed at specialized audiences and the public at large and supports the implementation of strategies, programs and action plans related to IHL treaty participation, the development of relevant domestic legal and policy frameworks and mechanisms for their implementation;
• Builds and maintains networks with key stakeholders in Rwanda dealing with relevant legal and thematic issues, including the Judiciary, Parliament, thinks-tanks, civil society, relevant UN agencies, international and national NGOs and with academic circles;
• Supports the provision of legal advice and technical assistance to national authorities and other interested parties including reviewing of draft laws and legal documents;
• Organizes and participates in seminars, courses, and national or regional conferences on topics related to IHL, multilateral developments, and the ICRC;
• Provides legal and policy analysis and advice related to the delegation strategies and operational activities; drafts legal opinions and proposes action aimed at obtaining better respect for IHL and other relevant bodies of law;
• Contributes to positioning the ICRC as a reference on IHL, its implementation and respect;
• Contributes to the Delegation’s humanitarian diplomacy efforts to influence and mobilize main stakeholders for ICRC humanitarian priorities in the country and the region;
Operational lnternational Humanitarian Law
• Under the supervision of the DHoD and in close coordination with the Deputy CoProt Detention and the FAS delegates, the Legal Advisor:
• Provides legal and policy analysis and advice related to the mission strategies and operational activities, particularly on classification of situations of violence and applicable legal frameworks;
• Analyses government policy positions, legislation and jurisprudence that may have repercussions on ICRC activities in places of detention in Rwanda;
• Prepares and updates in-house reference materials on laws and access to judicial guarantees for detainees visited by the ICRC in Rwanda and helps the detention team members understand the detention process, chain of custody and criminal justice system, human rights standards and national law, including judicial guarantees in Rwanda;
• Provides legal support and advice to FAS and PGE delegates in their activities and approach with security forces — and ensure a link with ICRC legal operational priorities
• Supports the Delegation in interacting with government authorities, especially legal advisers of the armed forces and relevant ministries, to further the delegation's operational objectives and to facilitate ICRC acceptance;
• Builds and maintains networks with interlocutors linked to legal questions relevant to the operational context;
• Advises the delegation, particularly PROT and PREV, on the appropriate use of the applicable legal framework and legal instruments in matters relating to detention, conduct of hostilities, protection of the civilian population, etc.
• Supports IHL dissemination activities directed at specialized audiences and the public at large and contributes the implementation of the Delegation strategies for its protection, prevention and humanitarian diplomacy strategies;
• Contributes to planning, implementing and monitoring the Delegation protection and prevention strategies.
• Contributes to the engagement with the public on the legal aspects of ICRC operations in Rwanda through the Delegation’s social media platforms;
• Participating in and contributing to PFR and budget elaboration and monitors its implementation.
Key qualifications and experience
• University degree in law
• Master’s degree or specialization in a discipline of public International law, including IHL or IHRL
• 3-5 years working experience in similar function
• Working experience in the government or the judicial sector
• Teaching/Dissemination experience including at academic level
• Fluent in either English or French
• Connections with the stakeholders in the legal circles in Rwanda
• Computer proficiency
Added Advantage:
• Admission to the bar/magistrate or PhD
• ICRC working experience
• Experience working in/or with international organizations;
