CONSULTANCY TERMS OF REFERENCE (TOR)

FOR THE DEVELOPMENT/ADAPTATION OF A GOOD PRACTICE HANDBOOK AND TRAINING OF PARTNERS ON SEXUAL EXPLOITATION, ABUSE AND HARASSMENT

Estimated performance period: (16 Days between March 2025-May 2025)

Organisation and Background information

The Kvinna till Kvinna Foundation is a Swedish non-profit organisation that supports women in conflict affected areas to increase women’s power and influence. Kvinna till Kvinna’s approach is based on strong local ownership and long-term support. Kvinna till Kvinna Foundation has defended women’s rights since 1993 For every woman and girl’s right to be safe and to be heard.

Kvinna till Kvinna has been present in Rwanda since 2017 and promotes human rights for all women. One of the focus areas of emphasis is strengthening women’s economic empowerment, for them to access opportunities for education, enter labour market, access financial resources and become financially independent.

With the support of the Germany Agency for International Cooperation (GIZ), Kvinna till Kvinna intends to implement the women’s economic empowerment project ‘Advancing Women’s Inclusion in Business’. The project aims to strengthen the economic participation of women in Rwanda with a focus on improving the working conditions of female employees in the private sector and enhancing competitiveness of women-led small and medium enterprises.

Kvinna till Kvinna believes that Human rights are safeguarding the right to live a life free of violence, discrimination and SEAH at work, to and from work, and at home.

In addition, the Convention on Violence and Harassment C190 from the International Labour Organization (ILO), which entered into force in June 2021, and ratified by Rwanda in November 2023 deserves particular attention in this context, as it is the first convention which clearly links expressed rights of women, and the right to live a life free of violence, with workers’ rights and employers’ responsibility to mitigate risk of violence also in the world of work, including to and from work as well as online. The convention provides international labor standards to prevent, remedy and eliminate violence and harassment in the world of work, including gender-based violence and harassment. A safe working environment is very influential in achieving a conducive work environment. One of the things to be paid attention to in creating a safe working environment is a working condition free of discrimination, including free of sexual harassment.

In regard to the above-mentioned project, Kvinna till Kvinna intends to develop a handbook contextualized to Rwanda on Protection from Sexual Exploitation, Abuse and Harassment (PSEAH) in the private sector.

Purpose of the assignment

The aim of the assignment is to have an increased knowledge of 23 project teams and 5 partners on PSEAH. This work includes the adaptation of the handbook as well as strengthening the capacity of personnel for partner organizations and senior management staff of identified companies to prevent and respond to cases of SEAH.

Scope of work

The consultant will be expected to undertake the following tasks: -

Phase 1: Detailing the assignment

  • Desk study: including review of key documents (e.g. ILO convention and related recommendation, national policies and law, company code of conducts, an existing Good Practice Handbook on PSEAH written by Kvinna till Kvinna for Swedfund and other relevant policies and reflect on the assessment that will be done by the Gender Equality Standard (GES) expert. The GES assessment material will be provided by Kvinna till Kvinna, we have an expert looking at this.
  • Meeting with Kvinna: Understand the requirements of the operation given the nature of Kvinna till Kvinna’s operations and mandate
  • Work plan: On the basisof above, provide a sequenced plan of actions, including the necessary preparatory work that must be completed prior to commencement of the adaptation of the Good Practice Handbook.

Phase 2. Adaptation of the Handbook

  • Guide and facilitate discussions and working sessions leading to the development of the PSEAH handbook.
  • Adapt the handbook based on the input and discussion with Kvinna (The PSEAH handbook to Highlight all appropriate strategies that will aid workers in reporting, investigation, referral, victim’s assistance and protection, accountability and justice mechanisms, etc).
  • Develop a presentation and facilitate an internal validation meeting of the PSEAH handbook and utilize the validation inputs and feedback to finalise the handbook

Phase 4: Develop learning material

  • Adopt existing learning and training content using the available material from Kvinna till Kvinna and the finalised handbook

Phase 5: Delivering training

  • Deliver training to 23 partnerorganization staff and company senior staff who will train companies on the handling and prevention of PSEAH and provide them with all related knowledge.

Deliverables:

  • Inception Report, the consultant is expected to produce an Inception Report for the assignment within 5 days after contract signing. Broadly, the inception Report should bring out the following: Detailed plan of actions and timeline of the assignment.
  • Prevention and response to Sexual Exploitation, Abuse and Harassment Handbook
  • Adopted training materials
  • Facilitate 1 training for partners and company Senior staff on the developed PSEAH
  • Training report detailing the objectives, methodology used, key topics covered, and knowledge gained with a summary of assessment evaluation from post and pre-test

Consultant qualifications and experience

a) Education:

  • Advanced university degree (a master’s degree) or equivalent in gender studies, social anthropology, law and women’s rights, Economics, Human resource management, sociology, public health, or other field related to Preventing Sexual harassment.

b) Relevant experience, knowledge and skills:

  • At least 5 years of promoting diversityin business sector, HR management or development experience, including children’s and women’s rights and violence prevention and response, in particular sexual exploitation, abuse and harassment.
  • Extensive knowledge of Rwanda gender equality and SEAH challenges
  • Proven and extensive knowledge and experience in developing handbooks and manuals and development of SEAH handbook is an added value
  • Proven experience in developing and facilitating training and capacity-building activities on fighting sexual harassment at work pace.
  • Deep understanding of SEAH guiding principles. Demonstrate understanding of issues related to confidentiality, data safety/security, and other ethical concerns related to protection issues. Excellent communication, facilitation and interpersonal skills.
  • Flexible work attitude: the ability to work productively in a team environment as well as independently, and the ability to handle requests or issues as they arise.
  • Fluency in English (Written & Oral) is required.

  • Financial offer detailing various costs associated with the delivery of the above services, in PDF.
  • The financial proposal must be a separate document from the technical proposal.
  • Minimum 3 references of the similar work done in the past with the name and contact details of the client or employer.
  • Company profile; VAT registration certificate; RRA tax clearance certificate; RSSB tax clearance certificate
